Terms of Service

The short version

Creating a PongLens account is free, and every account includes free video storage and free processing to start. You keep ownership of your videos and notes. You must have the right to upload them, which includes a parent's consent for anyone under 18 in the footage. A player under 13, or under 16 in Europe, uses PongLens through a parent's account. You control who you share your matches with. Coaches can sell match reviews. Buying extra processing minutes or storage is not available yet; until it is, you can request more for free. The service will keep changing as we build it. Don't abuse it.

1. Who we are and what this covers

These terms are an agreement between you and PongLens LLC, a New Jersey limited liability company that operates PongLens ("PongLens", "we", "us"). They cover your use of ponglens.com and the analysis services we provide. By creating an account or using the service, you agree to these terms and to our Privacy Policy.

2. The service

PongLens lets you upload table tennis match videos. Our software processes each video to remove dead time and to cut the match into individual points, and makes the results available for you to watch and download. You can add notes to points and matches, including voice notes that we transcribe, and you can share your matches with a coach. Recollect can automatically turn useful guidance from eligible lesson and practice notes into reminders that return over time. It is currently switched off.

Video processing happens on hardware we control in the United States, or on cloud computers we rent. It is done by our own software, including the checks that confirm the footage is table tennis we can work with.

Some features are optional. Voice notes, dictation and recorded lessons are transcribed by Deepgram, and lesson summaries (including the sound and a few still frames of a lesson video you import or film in the app), Ask, photo reading, Improve with AI, Recollect, match analysis and automatic scoring send the content they need to OpenAI. We ask you in the app before the first time an optional feature does that, and you can switch these features off in Account. Switching them off does not affect recording, uploading or processing matches. Neither company may use your content to train or improve its own models. Section 11 lists the categories of provider we use, and our Privacy Policy explains where your data is held.

3. Free allowances, minutes, and storage

A new account comes with a storage allowance for your videos and a one-time allowance of free processing minutes. Uploading a video uses storage; processing it into points uses minutes, charged by the video's length rounded up to the whole minute. Trimming a video before processing means you pay only for the part you keep. Uploading alone never uses minutes.

• Free minutes do not expire. If processing fails on our side, the minutes come back automatically.
• When you reach your storage limit, nothing you uploaded is deleted. Your library stays as it is; you just can't add more until you delete something or get more space.
• Buying extra minutes or storage is not available yet. Until it is, you can request more from inside PongLens at no charge. When purchases become available, minutes will be sold in packs that do not expire, and storage as a 12-month allowance; when a storage allowance ends, nothing you uploaded is deleted.
• Deleting a video frees its storage right away.
• Prices and allowance sizes may change; changes never reduce minutes or storage you already have.

A few things we can't promise:

• We don't guarantee uptime, processing speed, or that results will be perfect. Processing time depends on the recording and the queue.
• We may suspend or discontinue the service. If we do, we'll make reasonable efforts to give you a chance to download your videos and results first.

3a. Payments

Payments, which today means paid coach reviews, are processed by Stripe. Your card details go to Stripe directly and never touch PongLens servers. We store the purchase itself: what was bought, its price, and its status. Unused minute packs can be refunded on request; minutes already spent on completed processing are not refundable. Storage purchases can be refunded in proportion to the time remaining, on request. Contact us and we'll sort it out.

3b. Paid coach reviews

Coaches on PongLens can sell match reviews. The coach is the provider of the coaching service; PongLens provides the video tools, the order workflow, and payment processing through Stripe. When you buy a review, you pay the coach's listed price and nothing more, and PongLens keeps a platform fee from the coach's side of the transaction. A paid review includes the processing of the match you send, up to a stated length, without using your own minutes.

A coach sets their own price, scope, and expected turnaround. You can cancel for a full refund any time before the coach starts, and if a started review is more than a week past its promised date. Delivered reviews are final. Refunds go back to your original payment method.

A coach can also cover a review for a student they already work with by sending an invitation link. The student pays nothing; the coach funds that review through their PongLens account. Coaches receive payouts through Stripe after a review completes. Stripe handles identity checks, bank details, and tax forms; PongLens never sees them. Coaches are responsible for the advice they sell; PongLens facilitates the order and the payment.

4. Your account and your age

You sign in through Google, Apple, or a one-time email sign-in link or code. PongLens does not collect an account password. You're responsible for activity that happens under your account.

You can hold your own PongLens account if you are at least 13, or at least 16 if you live in the European Economic Area, unless your country sets a lower age. A younger player uses PongLens through an account created and held by a parent or legal guardian. The guardian accepts these terms on the player's behalf, is responsible for what happens in that account, decides what is shared and which AI-assisted features are used, and can delete everything at any time. If we learn that someone below the required age holds their own account, we will ask a parent or guardian to take it over, or we will delete it.

5. Your content and your responsibilities

Your content includes the videos you upload, the notes you write, and the voice notes you record along with their transcripts. You keep all rights to your content. In return, you promise that:

• You own the footage or have permission from whoever recorded it.
• People who appear in the video have consented to being recorded and to the footage being processed, where the law requires it.
• You won't upload anything unlawful, harmful, or unrelated to the purpose of the service.

Specifically, the following content is prohibited:

• Anything unlawful or that infringes someone else's rights.
• Footage of anyone under 18 without the consent of their parent or legal guardian.
• Recordings made without the knowledge or consent of the people recorded, where consent is required.

People under 18 in your videos. Table tennis is a junior sport, so this one matters. If anyone in a video you upload is under 18, you confirm that you have consent from that person's parent or legal guardian to record them and to have the footage processed, stored, and shared inside PongLens as these terms describe. You are solely responsible for obtaining that consent and for keeping it current, and you will delete the footage from PongLens if it is withdrawn. You also confirm you had the right to film where you filmed. Uploading footage of someone under 18 without that consent is a material breach of these terms, and we may remove the content and suspend the account.

You grant us a limited license to store, copy, and process your content to provide the service to you, including transcribing your voice notes, generating Recollect reminders and lesson summaries, showing your matches to people you share them with, and, when you let people keep a copy of a match, making a copy of it in the account of each person who keeps one.

We may also use your footage to test and improve how accurately PongLens finds the ball, the table, and the points. That is the only additional use we make of it, and we set hard limits on it:

• We do not train generative AI models on your footage, and we do not give your footage to AI model companies for their own purposes.
• We do not use your footage in marketing or on our website without asking you first.
• We do not publish it, sell it, or pass it to anyone outside the people you shared it with.
• You can opt out at any time. Email support@ponglens.com and we'll exclude your account. Opting out changes nothing else about your service.

If a PongLens coach asks to share a review of your match and you allow it, clips from that match and the coach's feedback may appear on the coach's social media. You can take that permission back at any time from the review.

If a parent or guardian holds the account, that decision is theirs to make for the player. We claim no other rights in your content.

6. Coach sharing

You can share a match, or all of your matches, with another user such as a coach. Sharing grants that named user access to the shared matches until you revoke it. What that means:

• You control your share links. You can revoke a share at any time, and access ends when you do.
• Someone you share with can view the shared matches, including your clips and notes, and can add their own notes. They cannot edit or delete your content.
• Notes a coach leaves on your match are visible to you. If you revoke access, you keep the notes they already left.
• Only share with people you trust to see your footage and notes.
• Sharing a link to a match or point, or sharing an exported video, means you confirm you have the right to share footage of everyone who appears in it.
• A share link works for anyone who has it, without signing in. Treat it like a key: send it only to people you want to see the footage, and revoke it when you are done.
• If you turn on Let people keep a copy, anyone with the link who has a PongLens account can add the match to their own account. Their copy is theirs. Turning off the link, or deleting your match or your account, does not remove it. You can see who kept a copy.
• When you keep a copy of someone else's match, it becomes your content under these terms. Only the video, the points, the score if they included it, and their starred points are copied.

6a. Coaches and their students

A coach decides what to record and write about their students, and is responsible for that content and for having whatever consents the law requires, including a parent or guardian's consent for a student under 18. PongLens stores and processes it on the coach's instructions.

A student, or the parent or guardian of a student under 18, can ask us to remove footage or notes about that student from any coach's workspace, and we will honour the request. When a student leaves a coach, the coach loses access to the student's matches but keeps the notes they wrote themselves, which remain their own record of the lessons they gave.

7. Storage and deletion

What we keep, and for how long:

• Your uploaded videos and cut videos: kept while your account is active and the video is in your library. They count toward your storage allowance, as does everything else you store: lesson videos, point clips, reels, voice notes and photos. Deleting a video removes it and frees the space.
• Voice note audio: deleted 90 days after recording. The transcript stays with your notes. Audio that is part of a delivered paid review is kept with the review.
• Point clips and match data: kept while your account is active, so you can keep reviewing your matches. They count toward your storage allowance and go when the match does.

See the Privacy Policy for details. PongLens is not a backup service; keep your own copy of any original video you care about.

8. Feedback

If you send us feedback about the service, including through the in-app feedback form, we may use it to improve PongLens, including improving the accuracy of our analysis. You don't need to send feedback, and doing so doesn't give us any rights to your match content beyond what these terms already grant.

9. Acceptable use

• Don't attempt to access other users' videos or data.
• Don't probe, overload, or disrupt the service.
• Don't use automated tools to bulk-upload content.
• Don't upload content you don't have the right to upload.
• Don't upload malware, or attempt to gain unauthorized access to the service or its infrastructure.
• Don't reverse engineer, scrape, or copy the service, or use it to build or train a competing product.
• Don't resell, sublicense, or commercially exploit the service or its output without our written permission.
• Don't circumvent usage limits, rate limits, or access controls.

We don't tolerate objectionable content or abusive behavior; we remove such content and may suspend or close the accounts that post it.

We may remove any content and suspend or terminate any account at our discretion, including (but not only) for violations of these rules.

10. Reporting content and takedown requests

Anyone can report content on PongLens that they believe is unlawful or breaks these terms, whether or not they have an account. Email support@ponglens.com with enough detail to identify the content and to explain the problem. We'll review your report within 24 hours, remove content that violates these terms or the law, and tell you what we decided. If we remove something, we tell the person who uploaded it why.

The same address is the route to use if you believe a video includes you, or your child, without consent.

Child safety. If we find sexual or abusive imagery of a child, we remove it, close the account that uploaded it, and report it to the National Center for Missing & Exploited Children, as US law requires. We also share information with law enforcement when the law requires it, as our Privacy Policy explains.

Copyright. If you believe something on PongLens infringes your copyright, send a notice to our designated copyright agent:

Your notice should identify the copyrighted work, identify the material on PongLens and where it is, give your name and contact details, and include a statement that you believe in good faith the use is not authorized, a statement under penalty of perjury that your notice is accurate and that you are the owner or are authorized to act for the owner, and your physical or electronic signature. If we remove your content after a notice and you believe that was a mistake, you can send us a counter-notice to the same address. We close the accounts of people who repeatedly infringe copyright.

11. Service providers

We use a small set of providers to run the service. Each one processes only what it needs for its role, and none may use your content to train or improve their own models:

• Authentication, database, and job queue.
• Private storage for video files, point clips, and voice note audio.
• Website hosting and cookieless, aggregate analytics.
• Email delivery, including one-time sign-in links or codes and notifications when your match is ready.
• Deepgram, for transcribing voice notes, dictation and recorded lessons.
• OpenAI, for the AI-assisted features described in section 2.
• Stripe: payment processing for purchases and coach payouts.

12. Disclaimers

The service is provided "as is" and "as available", without warranties of any kind, express or implied. Analysis output is automated and may contain errors. It's a training aid, not an official record of play or a substitute for a qualified coach. Recollect reminders may omit, simplify, or misunderstand guidance, so you should check their linked source before relying on them.

13. Limitation of liability

To the maximum extent permitted by law, PongLens will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, arising from your use of the service. Our total liability for any claim relating to the service is capped at the greater of $10 or the amount you paid us in the 12 months before the claim. Keep your own copy of any video you upload. Don't treat PongLens as a backup.

14. Indemnification

If someone brings a claim against us because content you uploaded violated their rights (for example, you didn't have permission to record or upload it) or because you broke these terms, you agree to cover the resulting costs, including reasonable legal fees.

15. Changes to these terms

We may update these terms as the product evolves. If we make material changes, we'll note the new date at the top of this page and, where practical, notify you in the app or by email. Continuing to use the service after changes take effect means you accept them.

We may transfer these terms, together with your account and content, to another company that takes over PongLens, for example if PongLens moves into its own company or is acquired. We'll tell you in the app or by email before that happens, and these terms and our Privacy Policy will keep applying.

16. Governing law and disputes

These terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules, and claims are brought in the state or federal courts located in New Jersey.

If you live in the European Union, the United Kingdom, or anywhere else whose consumer law cannot be signed away, nothing here takes those protections from you, and you can bring a claim in the courts where you live.
